Pro Bono Attorneys Find Possible Path to Green Card
Volunteers from Hogan & Hartson identified a detainee eligible for "grandfathering" under INA 245(i), a provision that allows certain immigrants who have entered without inspection to be sponsored for a green card by a family member. The clinic learned that if a detainee had a petition filed for her prior to 2001 that mentions a fine, 245(i) grandfathering could be a possibility. Volunteers are currently helping the detainee contact his adult USC children in order to facilitate the filing of a new petition.
