A case of uncertain job security due to multiple cancer diagnoses

Ms. R. is a 62-year-old female diagnosed with breast cancer who first contacted the Cancer Advocacy Project in 2006 for assistance in appealing a pre-existing condition denial from her long-term disability provider. Volunteer attorney Wendy Luftig appealed this denial, and Ms. R. was reinstated and received a check for all the back payments. Ms. R. then completed her treatment, went into remission and returned to work.

In July of 2008, Ms. R. contacted the Cancer Advocacy Project again after being diagnosed with lymphoma. She was out of work on disability; however, her job security was uncertain due to side effects from treatment and reasonable accommodation difficulties. Once again, Ms. Luftig returned to the case to contact Ms. R.'s employer regarding these issues.
