Developments in International Environmental Compliance & Enforcement

New developments are changing the face of environmental compliance around the world. Nearly 150 constitutions have been amended to expressly protect the environment, and more than 400 environmental courts and tribunals have been established. International courts and tribunals, including the International Court of Justice, have considered state-to-state cases relating to international environmental law. Cooperative information-sharing networks and industry-specific monitoring projects have developed to support environmental compliance and enforcement. This panel will describe these developments and address related, emerging issues, including the application of international environmental law in international tribunals, the role of the U.S. in international enforcement, increased prosecution for illegal trade in wildlife and hazardous substances, and the impact of new enforcement mechanisms on international business and investors.
