MFNs have attracted significant attention of late. Numerous articles have been written, a case is pending and debates surrounding their legality offer no clear rules. When are MFNs problematic and when are they simply a way to keep up with the competition. Our panel brings together regulators, practitioners, in-house counsel and economists who will give practical guidance on the MFN "danger zones"; how to mitigate potential antitrust concerns and what to do if challenged.
